Terms and Conditions


The following terms and conditions apply to all transactions processed by Swindon Computers Limited ("the Conditions"), incorporating SwindonComputers.com. All orders made are subject to the acceptance of these Conditions, and deemed to be accepted by you when placing your order. These Conditions do not affect your statutory rights. These terms and conditions are subject to change without notice and supersede all previous editions. For your peace of mind we adhere to the Consumer Protection (Distance Selling) Regulations.

1. PAYMENT

1.1 We will treat each order for goods as an offer by you to purchase the goods subject to these Conditions. You are deemed to accept the Conditions when you place an order for goods with us. Our contract with you only begins when we confirm acceptance of your offer to purchase goods from us. An order will not take place (and we will not be deemed to have accepted your order) until we have validated and confirmed your payment. Any communication, which you receive from us prior to validation, is not to be deemed as an acceptance of your order. In the event of any pricing error occurring within our website, within a written or verbal quotation, or contained within any fax or e-mail correspondence however received, all incomplete orders shall be deemed void.

1.2 We accept all major credit cards (except Amex), cheques, cash, wire transfer & BACS payments. In addition we accept official purchase orders from Government, Education, Healthcare and the Public Sector, at our sole discretion.

1.3 To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

1.4 All cheque, BACS, and wire payments must be cleared before any goods can be dispatched (please allow up-to 5 working days for clearance). Purchase Orders should be emailed directly to sales@swindoncomputers.com to reserve goods. However, goods will not be dispatched until we are in receipt of the original order. Alternatively official orders can be e-mailed to sales@swindoncomputers.com. Our bank details for BACS and Wire payments are available upon request from our sales team on 01793 616688.

1.5 Many of the goods we sell are of a technical nature and whilst we endeavour to publish as much information as is practical about the goods, the descriptions of the goods are as set out on the website. All drawings, photographs, descriptive matter, colour, specifications and advertising on our website are for the sole purpose of giving an approximate idea of the goods. They will not form part of the contract between us.

1.6 Title of the goods shall remain with Swindon Computers Limited at all times, and will not pass to you until we have received cleared funds for the full amount owed.

1.7 Goods purchased via Purchaser Order, Finance, or Lease, be it directly or indirectly will remain the property of Swindon Computrers Limited at all times, irrespective of your agreement with any third party. You shall not have the right to receive title, nor shall title pass to you, until we have received cleared funds for the full amount owed by you, or by any third party acting on your behalf.

1.8 Your order for goods is subject to stock availability. If we do not supply goods to you for any reason we will inform you of the situation and will not charge you for those goods, and will refund any money already paid by you for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of any unfulfilled order.

1.9 All prices quoted or displayed are in UK pounds sterling and shall be the price, inclusive of VAT & delivery, set out on the website at the time your order is placed. A delivery charge will be made and clearly shown in the orders section of the shopping cart before any online order can be placed, or as displayed on our website, or as quoted by phone. We are entitled to make adjustments to the price to take account of any increase in, or the imposition of any new taxes or duties. If due to an error or omission the price published for the goods on our website is wrong we have the right to terminate an order provided the goods have not been dispatched. We will try to ensure that all prices displayed on our website are accurate, but should an error occur we would inform you of the correct price and give you an opportunity to cancel the order, pricing may fluctuate daily, we can only honour that price on the day of purchase.

1.10 Payment for goods must be made in accordance with our purchase procedure as set out on our website. All orders are positively credit card sanctioned prior to dispatch. We can accept no responsibility if any details you provide us with that are incorrect or if any order is held up as a result of incorrect or unsubstantiated details.

1.11 Any clerical error or omission in any sales literature, quotation, pricing on the website, acceptance of offer, invoice or other document or information issued by the company shall be subject to correction without any liability on the part of Swindon Computers Limited.

1.12 We shall not be liable to you for any loss whatsoever relating to password or user name access to your account. It is your responsibility to protect your own password and or user name that has been forwarded to the e-mail address you have provided. Unless informed by you in writing as to the opposite we will consider any e-mail address given by you is indeed your own personal account and is secure. We take no responsibility for any third party abuse of your e-mail account.

2. WARRANTY

2.1 All new laptops are sold with the benefit, at minimum, of a 12-month guarantee, via our extensive trading partners (Excluding, software and some consumables) Full warranty details are available with your product, on our website within the product description, or from our customer services team. It is your responsibility to complete and return the purchase registration form enclosed with the goods to the manufacturer.

2.2 Extended warranties are supplied direct from the manufacturer and require the customer to register them with the manufacturer according to their terms and conditions; Swindon Computers Limited accepts no responsibility for failure by the customer to register their warranty packs in accordance with the manufacturers instructions.

2.3 All Refurbished laptops are sold with the benefit of a full 12-month Return To Base warranty unless stated otherwise. Should a fault occur and a returns number is supplied by customer services (Goods returned without a valid returns number will be returned to sender) your laptop will be repaired or replaced free of charge. If we are unable to affect a repair or replacement we will offer you a suitable upgrade (At our discretion) or a refund. Please note software is excluded from this warranty. It is your responsibility to return any faulty Refurbished product back to the place of purchase (Swindon Computers Ltd) at your own expense, whereupon these goods will be repaired or replaced and shipped back to you free of charge. If these goods are deemed tampered with, including loss or breach of warranty void stickers, in any way your warranty will become void and you will become responsible for the costs of repair and return shipping.

2.4 All other goods except laptops are sold with the benefit of a full 12-month Return To Base warranty. Should a fault occur please contact our Customer Service team for a returns number and we will look to repair the item immediately, or provide a refund if we are unable to provide a replacement. It is your responsibility to return any faulty product back to the place of purchase (Swindon Computers Ltd) at your own expense, whereupon these goods will be shipped back to you free of charge.

2.5 If these goods are deemed tampered with in any way your warranty will become void and you will become responsible for the costs of repair and return shipping. If no fault is found or software you have loaded has caused any hardware faults you will be responsible for the costs of repair and return shipping. Wherever possible we will respond to your individual circumstances. Swindon Computrers Ltd will not be liable for any transit damage that may occur on any product you have returned to us for repair. We strongly suggest that you make sure you have used sufficient packaging to protect your product and insure against damage before returning any product for repair. For advice on how to pack your goods safely before return please contact our Customer Service team.

2.6 The warranty does not cover, accidental damage, modifications to, failure(s) not due to manufacturing defect(s), software of any type licensed or otherwise, when any warranty void sticker has been tampered with, failure to comply with the original manufacturers conditions of intended use, any accessories supplied with a used laptop, or software corruption where re-installation of your operating system is necessary except due to hard drive failure. Swindon Computers Ltd cannot be held responsible for any costs arising from unauthorised repairs to equipment during the warranty period. Only Swindon Computers Ltd or the equipment manufacturer or their authorised service agents can carry out any warranty work. Any unauthorised repairs or repair attempts will void the warranty.

2.7 Batteries supplied with a new, used or refurbished laptop have a 3-month warranty and are only guaranteed to hold a charge for 30 minutes displaying a screensaver.

2.8 In relation to new goods the company will accept liability for defective goods only to the extent that the company is entitled to make a claim under the manufacturer's or publishers warranty and obtain from the manufacturer or publisher a refund, credit, repair or replacement of the defective goods.

2.9 Laptop Displays. Due to the nature of laptop displays there is normally a tolerance of faulty pixels allowed by the manufacturer before it will be deemed to be a faulty unit by the manufacturer. A laptop display will only be deemed faulty if the number of failed pixels exceeds the manufacturers stated amount in the manufacturers warranty conditions.

2.10 In the event of product failure we are not responsible for the loss of any data that may occur, nor whilst we repair or exchange this product under the terms of warranty.
You are strongly advised to back up all data on a regular basis.

3. DELIVERY

3.1 Delivery of the goods shall be made to UK mainland addresses only unless agreed otherwise, and must be signed for. The address will be that registered with your payment card issuer, unless you request otherwise and we agree to such a request (at our sole discretion). Once delivered to this address and a proof of delivery is obtained for that address, we cannot accept any liability for missing packages.

3.2 We will endeavour to deliver your goods if in stock within 2-3 working days (with the exception of weekends & public holidays) but time shall not be of the essence. If we are unable to deliver the goods for any reason you will be notified and will not be obliged to pay for the goods. If delivery of the goods is delayed by more than 30 days, you shall be entitled to contact us and cancel the order. Any monies paid in respect of goods, which are not delivered, will be refunded.

3.3 Next day deliveries must be processed before 4PM that day, if not they will be despatched the following day.

3.4 Goods, other than faulty goods, may not be returned after 10 days unless we agree that there is good reason for us to receive such goods back, if we agree to accept these goods back into stock they are subject to a 17.5% handling fee. We recommend that you make full use of our sales team for advice prior to purchase. We adhere to the Consumer Protection (Distance Selling) Regulations.

3.5 If goods arrive in a damaged or unsatisfactory condition you must inform us within 24 hours of delivery. We shall arrange collection of the goods (other than used goods) and will either replace the goods at no extra charge, or refund any monies paid by you for the goods, at our discretion. Swindon Computers Limited cannot accept liability whatsoever for claims made under section 3 (3.4) after this 24-hour period has elapsed.

3.6 Swindon Computers Ltd must be notified within 24 hours of delivery if any part of your order is missing, damaged or incorrect. Swindon Computers Ltd will accept no responsibility after this time period.

3.7 We will deliver to an alternative addresses at your request but stress that if instructed to do so, you are agreeing that anyone situated at your alternative address has your written authority to accept goods on your behalf and that the address is secure. We will accept no responsibility for goods once they have been delivered to and signed for at the requested address.

3.8 Delivery Charges. All our carriage charges are clearly displayed on our website.

3.9 No liability for direct or consequential loss; damage arising from any delay in delivery will be accepted by Swindon Computers Ltd.

4. RETURNS & REFUNDS

4.1 We will provide a full refund if the product you have selected is found to be unsuitable within 10 working days following delivery, excluding spare parts such as hard drives, laptop memory etc. Goods bought by and supplied to Businesses are deemed Business-to-Business transactions, which under the Distance Selling Regulations, are excluded from the 10-day cooling off period offered to normal consumers. In addition Goods that are built to order or customised in any way are also excluded from the 10-day cooling off period, under the Distance Selling Regulations, such as the Panasonic Toughbook computer range, Laptop Security Cabinets and their respective accessories, and any Laptop that's has been modified in any way at your request. Your warranty and statutory rights remain unaffected by these terms and conditions. Any laptop(s) returned within ten days for refund that requires re-installation of the operating system may be liable to a £25+ VAT charge which will be deducted from any refund due. Free Promotional items received with the purchased product must also be returned before a refund will be affected. Please contact our Customer Service team for a returns authorisation number. This number must be labelled on the product you are returning, items received without a returns authorisation number will be returned directly, it is your responsibility to pay the return delivery costs. The product must be returned unopened, however we will endeavour to respond to your individual needs where possible. Returns authorisation numbers are valid for fourteen days.

4.11 Software supplied that does not show any product key externally may be returned but must be un-opened and unregistered. Any software that shows a product key externally and that requires registration with the manufacturer to allow it to function fully is not returnable or refundable.

4.2 All products come with the benefit, at minimum, of a 12-month guarantee unless stated otherwise against faulty materials and workmanship only (excluding software and some consumables). Depending on the nature of the fault and the type of product, we will endeavour to assist you via our own in-house technicians, through our Customer Service team, or by directing you to one of our recommended trading partners repair centres.

4.3 You shall not be entitled to a refund or replacement of damaged goods if the defect arises because you fail to follow the manufacturers instructions as to use, installation, commissioning or maintenance of the goods, or you alter or repair such goods without our written consent.

4.4 If your goods become faulty within the first 12 months (excluding software, used laptops and some consumables) a repair will be carried out free of charge. We will endeavour to offer you a fast and efficient after sales service. Your statutory rights remain unaffected by these terms and conditions.

5. ORDER CANCELLATIONS

5.1 We must receive by email any notice of cancellation of your order within 24 hours, quoting your unique order reference number given at time of purchase, to sales@swindoncomputers.com. We can not accept cancellations over the telephone. If however your order has already been despatched then normal terms for returning your purchase will apply see returns section 4 above.

6. MISCELLANEOUS

6.1 We shall not be liable to you for any failure or delay in performance of our contract. If it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.

6.2 All orders placed through, or using information from this Website are subject to these terms and conditions, at all times.

6.3 These terms are subject to English law and the parties agree to submit to the exclusive jurisdiction of the English Courts.
